Municipal

Howard and McMillan has extensive background and experience in representing Connecticut municipalities. William Howard has been acting as Town Attorney for various towns in Connecticut since 1976, most recently representing the towns of Haddam (1976 through 1997), Chester (1991 through 1993) and Killingworth (1993 through 2005). Attorney Howard currently represents the Deep River Zoning Commission, and Killingworth’s Planning and Zoning Commission, Zoning Board of Appeals and Inland Wetlands and Watercourses Commission (since 1993) and was also appointed as Corporation Counsel for the City of Middletown in 2005. Attorney Howard serves on the Executive Board of the Connecticut Association of Municipal Attorneys ("CAMA").

Particular areas of municipal representation have included:

  • Real estate matters, including land acquisitions and conveyances
  • Land use law, including planning, zoning, affordable housing, inland wetlands, conservation, historic district commission, zoning enforcement, building code, sanitation and housing matters
  • Tax appeals and tax foreclosures, including summary tax foreclosures
  • Municipal tax sales and assignments of tax liens
  • Municipal bidding, contract negotiation and collection matters
  • Charter interpretation and revision
  • Sewer assessment appeals
  • Civil rights matters
  • Freedom of Information issues, hearings and appeals
  • Municipal issues involving cellular antennas and towers

On April 11, 2006, Howard and McMillan secured a very favorable decision for the zoning agencies of the Town of Killingworth in the case of Graff v. Zoning Board of Appeals, 277 Conn. 645, 894 A.2d 285 (2006). The Justices of the Connecticut Supreme Court reversed a lower court’s decision and concluded that Killingworth’s zoning agencies acted properly when they applied an “accessory use” zoning regulation to enforce a limitation on the number of dogs a property owner can keep on a residential property. This was a very significant decision, not only for the Killingworth zoning agencies, but also for the law of zoning because it affirmed and strengthened the authority of local zoning agencies to interpret and enforce the accessory use provision of their zoning regulations. A municipality that uses the firm of Howard and McMillan as its Town Attorney, has all the resources of a big firm practice (depth of experience, paraprofessionals on staff, computer research capabilities) with very few of the drawbacks. With a much lower overhead than our big firm colleagues, we can afford to bill our municipal clients at a lower hourly rate. In addition, our hourly rate includes the cost of computer research, routine copies and faxing; our big firm colleagues often pass those expenses on to their clients. We can be flexible in our billing schedules, depending on the client's needs. And, above all, we are available to you right here in Middlesex County, not Hartford, New London or New Haven.
