On April 11, 2006, Howard and McMillan secured a very favorable decision for its clients, the zoning agencies of the Town of Killingworth, in the case of Graff v. Zoning Board of Appeals, 277 Conn. 645, 894 A.2d 285 (2006). The Justices of the Connecticut Supreme Court reversed a lower court’s decision and agreed with the arguments of Attorneys William Howard and David J. Tycz to conclude that Killingworth’s zoning agencies acted properly when they applied an “accessory use” zoning regulation to enforce a limitation on the number of dogs a property owner can keep on a residential property. This was a very significant decision, not only for the Killingworth zoning agencies, but also for the law of zoning because it affirmed and strengthened the authority of local zoning agencies to interpret and enforce the accessory use provision of their zoning regulations. Jane S. McMillan was recently elected the first Director Emeritus of the Middlesex County Community Foundation, an organization which she helped found in 1997. In particular, Attorney McMillan helped establish the Swaim String Program which teaches students in the third, fourth and fifth grades to play string instruments.
